TFG Wireless Terms Of Use

You are about to access the Internet through wireless services (the "Service") operated by The Friedkin Group.  The purpose of the Service is to provide free, non-public, wireless Internet access to customers, guests, associates, and service providers of The Friedkin Group. You may use the Service only if you agree to the following terms of service each time you access the Service. Your use of the Service represents your agreement to these terms. If you do not agree with these terms, do not use the Service.

Your access to the Service is completely at the discretion of The Friedkin Group, and your access to the Service may be blocked, suspended, or terminated at any time for any reason. The Friedkin Group may revise the TOS at any time. Each time you use the Service it is your responsibility to review the TOS for any changes.  

Please remember: No network communication should be considered private or protected. All communication over The Friedkin Group network is subject to monitoring, collection, and use at The Friedkin Group’s discretion, including sharing such information any law enforcement authorities, rights-holders, and The Friedkin Group’s vendors and service providers.

Acceptable Use of the Service

Your use of the Service and any activities conducted online through the Service shall not violate any applicable law or regulation or the rights of The Friedkin Group, or any third party. The Friedkin Group cannot accept any responsibility for any injury or loss that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

You acknowledge (i) that the Service may not be uninterrupted or error-free; (ii) that viruses or other harmful applications may be available and your device may be exposed such viruses or other harmful applications through the Service; and (iii) that The Friedkin Group does not guarantee the security of the Service and unauthorized third parties may accesses your device or files or otherwise monitor your connection.

The Service is provided on an "as is", "as available" basis without warranties of any kind. All warranties, conditions, representations, indemnities and guarantees with respect to Service and the operation, capacity, speed, functionality, qualifications, or capabilities of the Service, whether express or implied, arising by law, custom, prior oral or written statements by The Friedkin Group, or otherwise (including, but not limited to any warranty of satisfactory quality, merchantability, fitness for particular purpose, title and non-infringement) are hereby overridden, excluded and disclaimed.

Prohibited Activities

You must not use the Service to conduct or engage in any activities that: (i) are defamatory, threatening, intimidating or which could be classed as harassment; (ii) contain obscene, profane or abusive language or material; (iii) contain pornographic material; (iv) contain offensive or derogatory images regarding sex, race, religion, color, origin, age, physical or mental disability, medical condition or sexual orientation; (v) contain material which infringe third party’s rights (including intellectual property rights); (vi) may adversely affect the manner in which we carry out our work; (vii) contain forged or misrepresented message headers, whether in whole or in part, to mask the originator of the message; (viii) are bulk and/or commercial messages; (ix) invade another’s privacy; (x) distribute internet viruses, trojan horses, or other destructive software; or (xi) are otherwise unlawful or inappropriate. You must not use the Service to access illegally or without authorization computers, accounts, equipment or networks belonging to another party, or attempting to penetrate security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information gathering activity.

Under no circumstances will The Friedkin Group, its related entities, suppliers or licensors, or their respective officers, directors, employees, agents, and affiliates be liable for consequential, indirect, special, punitive or incidental damages, whether foreseeable or unforeseeable, based on claims (including, but not limited to, unauthorized access, damage, or theft of your system or data, claims for loss of goodwill, claims for loss of data, use of or reliance on the service, stoppage of other work or impairment of other assets, or damage caused to equipment or programs from any virus or other harmful application), arising out of the Service, breach or failure of express or implied warranty, breach of contract, misrepresentation, negligence, strict liability in tort or otherwise.

You agree to indemnify and hold harmless The Friedkin Group, its related entities, its suppliers and licensors, and their respective officers, directors, employees, agents and affiliates from any claim, liability, loss, damage, cost, or expense (including without limitation reasonable attorney's fees) arising out of or related to your use of the Service, any materials downloaded or uploaded through the Service, any actions taken by you in connection with your use of the Service, any violation of any third party's rights or an violation of law or regulation, or any breach of the TOS. This section will not be construed to limit or exclude any other claims or remedies that The Friedkin Group may assert under the TOS or by law.

The TOS shall not be construed as creating a partnership, joint venture, agency relationship or granting a franchise between the parties. Except as otherwise provided above, any waiver, amendment or other modification of the TOS will not be effective unless in writing and signed by the party against whom enforcement is sought. If any provision of the TOS is held to be unenforceable, in whole or in part, such holding will not affect the validity of the other provisions of the TOS.

The TOS constitutes the complete and entire statement of all terms, conditions and representations of the agreement between you and The Friedkin Group with respect to its subject matter and supersedes all prior writings or understanding.
